Pursuant to the bill (Reg. No. 6595), a no smoking policy operates everywhere except where permission signs are displayed, and in the personal residential premises, on condition that consumption of tobacco goods does not violate the rights of the persons staying in these or neighbouring premises for rest and clean air.

 

By the subject of legal regulation, the bill refers to the sectors of public health, environmental protection and the competition rules. In the EU, these fields are regulated by the WHO Framework Convention on Tobacco Control; Directive 2001/37/EC of the European Parliament and of the Council of 5 June 2001 on the approximation of the laws, regulations and administrative provisions of the Member States concerning the manufacture, presentation and sale of tobacco products; Directive 2003/33/EC of the European Parliament and of the Council of 26 May 2003 on the approximation of the laws, regulations and administrative provisions of the Member States relating to the advertising and sponsorship of tobacco products; Council Directive 89/552/EEC of 3 October 1989 on the coordination of certain provisions laid down by Law, Regulation or Administrative Action in Member States concerning the pursuit of television broadcasting activities; Council Directive 95/59/EC of 27 November 1995 on taxes other than turnover taxes which affect the consumption of manufactured tobacco. These legal relations are also regulated by the Commission Decision of 5 September 2003 on the use of colour photographs or other illustrations as health warnings on tobacco packages, Council Recommendation of 5 June 2001 on the drinking of alcohol by young people, in particular children and adolescents; Decision No 1786/2002/EC of the European Parliament and of the Council of 23 September 2002 adopting a programme of Community action in the field of public health.

The Committee members concluded that the bill complied with the above-mentioned international acts.
